In terms of the Local Government: Municipal Electoral Act, 27 of 2000, parties and ward candidates must comply with certain requirements when submitting party lists and forms for contesting the elections. Party lists and independent ward candidate nominations must be submitted to the office of the Municipal Electoral Officer (MEO) in each municipality in the country, on a date to be stated in the election timetable. REQUIREMENTS FOR PARTIES CONTESTING AN ELECTION BY WAY OF PARTY LISTS

  • Submit notice of intention to contest the election (the prescribed form will be supplied by the IEC)
  • Submit a party list
  • Pay a deposit in the amount prescribed by the Commission (only bank guaranteed cheques will be accepted)
  • Submit an acceptance of nomination form signed by each candidate on the list
  • Submit a certified copy of the first page of the identity book of each candidate on the list (the page with his/her photograph and personal details)

REQUIREMENTS FOR INDEPENDENT WARD CANDIDATES CONTESTING AN ELECTION
  • Submit a nomination form signed by a person nominating the candidate (the prescribed form will be supplied by the IEC)
  • Submit on the prescribed form a list of the signatures of at least 50 voters whose names appear on the segment of the Voters’ Roll for any voting district in the ward in question (this will serve as proof of support for the candidature of the nominee)
  • Sign and submit the prescribed acceptance of nomination form
  • Provide a certified copy of the first page of your ID book (the page with your photograph and personal details)
  • Pay a deposit in the amount prescribed by the Commission (only bank guaranteed cheques will be accepted)
ELECTION DEPOSITS

The Commission is empowered in terms of sections 14(1)(b) and 17(2)(d) of the Act to prescribe the amounts to be paid as deposits for contesting each election.

These amounts have been prescribed for the coming municipal elections:
  • R3 000 – Metro Council (submit party list and ward candidates)
  • R2 000 – Local Council with wards (submit party list and ward candidates)
  • R1 000 – Local Council without wards (submit a party list)
  • R1 000 – District Council (submit a party list)
  • R 500 – Independent Ward Candidates
FORFEITURE/RETURN OF DEPOSITS

Unless the deposit is to be forfeited in terms of section 78(2)(c) of the Act, section 83(1) of the Act obliges the Commission to refund election deposits to parties or candidates if:
  • a party wins at least one seat in the municipal council the election of which that contested
  • the ward candidate received at least 10% of the total number of votes cast in the ward election
Refunds will be paid out either by the IEC head office or at the local level, according to the wishes of the party or candidate.

PROGRAMME FOR SUBMISSION OF NOMINATIONS

19 October 2000 – Submission of candidate nominations

24 October 2000 – Compliance date for all those issued with notices of non-compliance
30 October 2000 - Compilation and certification of party lists and lists of candidates,                               and making these lists available for inspection at offices of the                               Commission's local representatives.
