The registration of political parties is carried out in terms of section 15(6)
of the Electoral Commission Act of 1996 regulated in terms of the Regulations
for the Registration of Political Parties of April 1998.
National and Provincial Election Registration
Local Government Election Registration
In terms of section 2(1) of the Regulations, a party submitting an
application for registration must provide the following:
- Copy of it's Constitution
- Deed of Foundation (50 signatures of South African citizens eligible
to vote vouching that they know of the existence of this party)
- Two sets of logos in colour attached to a prescribed form provided
by the IEC
- R500 registration fee
- A proof of advertisement for intended application published in the
Government Gazette
Once all these documents have been received they are then scrutinised and
put together in a file that is sent to the Chief Electoral Officer. The
CEO, on the basis of the information provided, will then approve or
reject the application.
The registration of a political party entitles the party to apply to the
Commission for inclusion in the Party Liaison Committees as set out in the
Regulations for Party Liaison Committees of 1998. In terms of this
regulation a party automatically qualifies to sit on the Party Liaison
Committee if that party has acquired a seat in a legislature in an
election. However registered parties without representation in any of
the legislatures are required to apply in writing to the Commission for
co-option on to a Party Liaison Committe.
A Party submitting registration must comply with the following requirements:
-
The Party must have submitted in a local newspaper or government gazette a “Notice of intent to register”
before the actual date of submission for registration
-
Deed of Foundation (50 signatures of South African citizens eligible to vote
vouching that they know of the existence of this party)
-
The Party Logos submitted for registrations must be in colour only
-
This is a checklist that can be used to ensure that a party has submitted all
the required party documentation
These are the documents required for party registration
Note: Registration at Local Council level does not automatically register the
party within the District Council. Parties wishing to contest within a DC
election should register separately.
Once all the documentation has been received they are then scrutinised and put
together in a file that is sent to the Chief Electoral Officer. The CEO, on the
basis of the information provided, will then approve or reject the application.
