Resolutions taken by the provincial executive councils (cabinets) and subsequently by the National Council of Provinces to dissolve one district council in the North West and local municipal councils in Kwazulu-Natal and the Eastern Cape have triggered by-elections spanning all wards in seven municipalities on 26 November 2014.
The councils were dissolved in terms of Section 139 of the Constitution which allows provincial executive councils to dissolve a municipal council and call for fresh elections in exceptional circumstances where the municipality cannot fulfil its functions and obligations.
This “last resort” mechanism has seldom been employed in democratic South Africa.
The three dissolved councils are Inkwanca [Molteno] – EC133 in the Eastern Cape; Mooi Mpofana [Mooirivier] – KZN223 in KwaZulu-Natal; and Ngaka Modiri Molema District Council [DC38] in North West. The Ngaka Modiri Molema District Council [DC38] comprises five municipalities i.e. Ratlou [Setlagole] – NW381, Tswaing [Delareyville] – NW382, Mafikeng [Mahikeng] – NW383, Ditsobotla [Lichtenburg] – NW384 and Ramotshere [Zeerust] – NW385.
The effect is municipal elections across 111 wards in the seven municipalities. In addition, regular by-elections (due to resignation or death of the councillors) are also scheduled for a further 21 wards around the country bringing to 132 the number of by-elections being held on this day.
This is just one less than the total number of ward by-elections held during the 2013/14 financial year.
In Limpopo, 13 wards in Mogalakwena [Potgietersurs] – LIM367 are vacant after the governing party (ANC) expelled its incumbent councillors. This action is being challenged in the Gauteng North High Court with a hearing scheduled for next week.
The remainder of the by-elections will take place in Maluti a Phofung [Qwa-Qwa] – FS194 in the Free State; Ulundi [Ulundi] – KZN266 in KwaZulu-Natal; Govan Mbeki [Highveld Ridge] – MP307, Mkhondo [Piet Retief] – MP303 and Umjindi [Barberton] – MP323 in Mpumalanga; KAI !GARIB [Keimoes] – NC082 in the Northern Cape; Theewaterskloof [Caledon] – WC031 and Overstrand [Greater Hermanus] – WC032 in the Western Cape.
In total, more than 450 000 registered voters are eligible to vote in 633 voting districts on 26 November making it one of the largest mobilisation of voters outside of general elections in South Africa to date.
Full municipal elections (for both ward candidates and PR candidates) will be held in Inkwanca [Molteno] – EC133 and Mooi Mpofana [Mooirivier] – KZN223. In these municipalities voters will receive two ballot papers (one for ward and one for PR candidates).
However, voters in five municipalities comprising the Ngaka Modiri Molema District Council will only vote for the 40% proportional representation (PR) in the District Council and will receive just one ballot paper show the list of political parties contesting a particular council (similar to that of ballot papers in 2014 national and provincial elections).
Within 14 days of the 26th of November, local council representatives in these councils will elect the remaining 60% of representatives to the Ngaka Modiri Molema District Council which then completes the process.
For the two local councils, parties will be required to give notice by 3 November 2014 of their intention to contest the elections, and on the same day submit their lists and candidates nominations.
The Electoral Commission will open all voting stations this weekend (18 and 19 October 2014) to give first-time voters the opportunity to register and those who have moved a chance to re-register where they now live. Stations will be open from 8am to 5pm on both days.
Voters are reminded that for municipal elections you can only vote in the voting district where you are registered and normally live. It is a criminal offence to register and vote where you are not normally resident.

ELECTION TIMETABLE FOR ALL MUNICIPAL BY-ELECTIONS CALLED ON OR BEFORE 24 OCTOBER 2014 TO BE HELD ON 26 NOVEMBER 2014
The cut-off dates for the various electoral processes for these by-elections are as follows:
24 October: Close of the voters’ roll
27 October: Publication of the election timetable
30 October: Cut-off date: Certification and publication of voters roll by making it available
30 October: Notice: List of addresses of voting stations open for inspection
30 October: Notice of routes, including the locations and times of stopping of mobile voting stations
3 November at 17h00: Cut-off date: Party must submit a notice of intention to contest the election, a party list with documents and deposit
3 November at 17h00: Cut-off date: Submission of nomination of a ward candidate together with documents and deposit
4 November: Cut-off date: Notify party/independent nominator of non-compliance regarding outstanding ward candidate documents
