The Constitutional Court today granted an interim order in which the Electoral Commission (IEC) is ordered to request the MEC for Local Government in KwaZulu-Natal to postpone the by-election in ward 22 in the Abaqulusi [Vryheid] Municipality – KZN263, KwaZulu-Natal. The by-election was scheduled for tomorrow, 7 August 2013.
This is the second postponement of the by-election that was originally scheduled to take place on 24 April 2013. The interim order is a sequel to an application brought to the court by Mr. André Lötter following an earlier application of his in the Electoral Court that resulted in the postponement of the 24 April by-election. The issue at hand is allegations of fraudulent registration for the by-election by voters. Written submissions must be made to the Constitutional Court by 20 August why the matter should not be remitted to the Electoral Court to determine the adequacy of investigations of the allegations and matters related to that.
The immediate implication from this order is that the by-election will no longer proceed on Wednesday, 7 August 2013 as scheduled. It is brought to the attention of voters registered in this ward that no voting will take place tomorrow (Wednesday, 7 August 2013) at the following voting stations:
